Our mission is to empower every nutrition & wellness professional with solutions that will make their practice successful and have a bigger impact over their clients nutrition. Central to this mission is our commitment to be transparent about the data we collect about you, how it is used and with whom it is shared.

This Privacy Policy applies when you use our Services (described below). We offer our users choices about the data we collect, use and share as described in this Privacy Policy, Terms and Services.

1. GENERAL

The MealPlanner Europe Ltd and its affiliates (“MealPlanner” or ”We”) respect your privacy and endeavor to safeguard your privacy (“You”) when using FoodToDo, or other MealPlanner services. This document (“Privacy Policy”) provides You with information on our privacy practices and how We process Your data, including personal data, and how We protect such data.

Personal data refers to data which allows You to be specifically identified as individual person. MealPlanner may also collect “non-personal data” meaning it can’t be used to specifically identify any persons. Non-personal data may also be the result of removing personally identifiable parts from the data.

We collect and use both types of data and combinations of both types. We are not responsible for the actions of third-party people, companies or services, the content of third-party sites or services, the use of data You provide to them or any products or services they may offer.

This Privacy Policy applies to the use of the FoodToDo service products, which consist of our website www.themealplanner.com, a downloadable application and other related connection services enabling You to access the FoodToDo services (“FoodToDo”), and You should read this Privacy Policy before using FoodToDo. By using FoodToDo, You express your agreement to this Privacy Policy and the processing of your personal data based on Our agreement with You in the manner provided in this Privacy Policy. If You do not agree to the terms of this Privacy Policy, you must not use FoodToDo.

2. COLLECTING AND USING PERSONAL DATA

We will only collect personal data to the extent necessary for providing our services and to enable You to use FoodToDo based on an agreement with you. Personal data may be collected and used for the purposes of creating user accounts, user profiles, using, maintaining and developing FoodToDo, contacting users, providing services and products, sending customer information and marketing communications (as outlined below and as applicable under the applicable laws) to users, enabling use of FoodToDo and communication in FoodToDo and between users, conducting research and creating reports for internal use.

MealPlanner will pursue to take appropriate measures to prevent unauthorized access to personal data, any inappropriate use thereof and any possible inaccuracies. All personnel processing personal data are obliged to keep such data strictly confidential. We may store data on servers and equipment in other countries (as outlined below). By using FoodToDo You always disclose data to MealPlanner. Your data will be kept private unless You choose to disclose it or parts of it to other users (in connection with Your interacting with other users, as outlined below). To enable You to interact with other users, MealPlanner may at times offer You the ability to post content (such as recipes, meal plans and other content) in connection with Your use of FoodToDo (including chat and other forums).

By interacting with other users, You may choose to disclose information to other users through FoodToDo, e.g. private users can share their medical data such as lab tests, diseases, treatment and medication, symptoms with professional users. MealPlanner is not responsible for any disclosures by the other users of such personal (or other) data You have chosen to share.

3. COLLECTED PERSONAL DATA AND SOURCES AND ACCURACY OF DATA

The type of data We collect and store will vary depending on Your use of FoodToDo and Your activity. We may collect the following personal data when You sign up for FoodToDo, or later in connection with Your use of FoodToDo:

first name and last name

company name of professional users

contact data (postal address, e-mail address and telephone number)

gender

birth date

years of experience of professional users

language preferences

user name and password

starting and ending moment and method of the customer relationship

direct marketing choices

interests and other information provided by the customer

dietetic information and other health and nutritional details required for the provision of services

anthropometric information

location data

information of the use of our products and services

payment information of professional users

technical data sent to us by your digital devices (such as computers and mobile devices) as well as information related to cookies and other similar technologies

recordings of customer service e-mail correspondence and telephone conversations

campaigns and promotions directed to the customer, as well as their use

purchase history

billing, delivery, returns and payment collection data (excluding bank account or credit card information unless needed for reimbursement purposes)

content, correspondence and consequences related to feedback and complaints

FoodToDo may be able to access Your user account(s) in third-party services (including associated data and other material) to allow You to interact with such third-party services using FoodToDo. MealPlanner may be able to connect to Your user account(s) in third-party services to interact with such third-party services to allow You to use Your data and other material and, consequently FoodToDo may be able to obtain certain data from Your user account(s) in third-party services when such third-party services permit such interaction.

IP-addresses, operating system, access and usage times and activity logs, browser type and language and referring website addresses might be collected automatically also when You use FoodToDo. MealPlanner may use this information to monitor and analyze the use of the services, contact You about Your experience with MealPlanner sites and services and notify You about company news and promotions. MealPlanner collects data about all of Your interactions with FoodToDo and with the other users inside FoodToDo (including chat) via server log files and other activities in FoodToDo and within FoodToDo related services. We may, at our own initiative or upon Your request, complement, correct or delete incomplete, inaccurate or outdated personal data.

4. DISCLOSING AND TRANSFERRING YOUR DATA

MealPlanner does not sell, trade, or otherwise disclose Your personal data to third parties unless otherwise stated below.

We may share your personal data with authorized third parties who perform services for us for the purposes described in this Privacy Policy within the limits of the applicable legislation, such as our website hosting partners and other parties who assist us in operating our website, providing customer service, managing and analyzing personal data, conducting research and managing marketing campaigns. Because we take the responsibility to safeguard your personal data seriously, we do not allow those companies to use it for any purpose other than to perform those services, and we require them to protect your personal data in consistence with this Privacy Policy.

We may also share your personal data or profile for targeted in-service marketing (including serving ads to users) or similar purposes and with carefully considered third parties for other joint or independent direct marketing purposes. Sharing of your data for such purposes may only happen when the planned purposes of the third party are not incompatible with the purposes described in this Privacy Policy, and the third party has a legitimate interest, such as marketing, for the processing of the personal data. Only the minimum necessary amount of your personal data is shared with third parties.

In addition, We may share Your personal data based on a valid order from a court or other official body with sufficient authority, if required under any applicable law or regulation, or to enforce the Terms of Service of FoodToDo and to investigate possible infringing use of FoodToDo as well as to guarantee safety of FoodToDo.

Furthermore, We may share your personal data as part of any merger, acquisition, sale of company assets or transition of service to another provider. This also applies in the unlikely event of an insolvency, bankruptcy or receivership in which Your personal data would be transferred to another entity as a result of such a proceeding.

We reserve the right to use anonymized data for the purposes outlined in the Terms of Service, including to enhance FoodToDo. Anonymized data means that data is made anonymous (e.g. aggregated data from statistical analyses of users’ aggregate behavior) and cannot be used to identify individual users. Such aggregate or anonymous data about You may be shared with advertisers, business partners and other third parties. If You have given your consent to share your data with third parties for their own marketing purposes, such marketing is governed by their separate privacy policies.

We use external service providers to provide technical solutions for processing stored data and access the stored data by using a technical interface. We host the service in and may transfer data for this purpose to and from countries outside the European Union (EU) or the European Economic Area (EEA). Please note that We may transfer Your data, including personal data, to countries (including the United States) and jurisdictions that do not have the same data protection laws as in the EU/EEA. We will always transfer personal data about You in accordance with the mandatory legislation and this Privacy Policy. Transfers will always be made either based on the European Commission’s adequacy decisions or using standard data protection clauses in the contracts between us and the receivers of the data to safeguard the protection personal data. Our service providers and other partners in the United States comply with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention when We transfer personal data to such service providers and partners.

5. PROTECTING PERSONAL DATA (DATA SECURITY)

Your personal data will be maintained in external service providers’ servers with appropriate safeguards, such as password protection, granting the access to the stored data only to MealPlanner. The personal data is protected by appropriate industry standard, technical and organisational safety measures. The data will be accessible only to persons or organizations operating by MealPlanner’s assignment or on behalf of MealPlanner expressly authorized by MealPlanner.

Although We make good faith efforts to store the data collected on the services in a secure operating environment that is not available to the public, and use only reliable partners We cannot guarantee the absolute security of that data during its transmission or its storage on our systems. We do not represent or warrant that Your personal data will be protected against, loss, misuse, or alteration by third parties.

6. COOKIES AND THIRD-PARTY SERVICES

A cookie is a string of information or a small text file that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. MealPlanner uses cookies to help it identify and track visitors, their usage of FoodToDo and themealplanner.com website, and their website access preferences, improving quality, tailoring recommendations, and developing FoodToDo related services.

Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using FoodToDo and/or themealplanner.com website, with the drawback that certain features of the website may not function properly without the aid of cookies. The cookies will not enable MealPlanner to access and review data stored on a user’s computer. FoodToDo may contain third-party tracking tools from our service providers, examples of which include Google Analytics and Count.ly. Such third-party services are governed by separate privacy policies and this Privacy Policy does not apply to such third-party data collection.

Third party service providers may use cookies, APIs, and SDKs in FoodToDo to enable them to collect and analyze user data on our behalf. Our service providers may have access to, for example, the following data:

MAC address,

IMEI,

locale,

geo-location data, and

IP address.

From time to time, there may also be other third party products/services or links to such available for Your use in FoodToDo. For example, FoodToDo may include social media features, such as the Facebook “like” button and widgets, such as the “share” button which may collect your IP address, information from what page you have entered the service, the browser you are using, or the sections of the service you have been browsing and the dates and times thereof. Social Media features and widgets are either hosted by a third party or directly on our services. All such third party services are governed by separate privacy policies (and Terms and Conditions) and this Privacy Policy does not apply. MealPlanner will not be responsible for such third party data collection. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

7. OUR POLICIES CONCERNING CHILDREN

If we learn that we have inadvertently gathered personal data from a child under 15 years of age, we will take reasonable measures to promptly remove that data from our records.

8. STORAGE TIME OF PERSONAL DATA

We will not retain Your personal data for longer than is necessary for the defined purpose of the processing of personal data or for legal requirements. For instance, we may retain some information for a few years after you have discontinued the use of FoodToDo by closing your Account, if this is necessary to meet our legal obligations or to exercise, defend or establish legal rights.

9. ACCESS TO AND CONTROL OVER PERSONAL DATA

You are entitled to review any data collected on You and stored by us, if any. Should You wish to exercise the above right to review stored data on You, You should send a signed request thereof to MealPlanner using the contact details below.

If there should be a mistake in Your personal data or it should be incomplete, You have the right to demand correction of the erroneous data or completion of the data by contacting MealPlanner using the contact details below.

If you no longer wish to use FoodToDo, or subject to other applicable legal provisions, You have the right to request MealPlanner to erase Your personal data stored by it to the extent that it’s further processing is not necessary or allowed by law.

You will only receive direct marketing from us in electronic form (such as email), if You have opted-in for such direct marketing by giving Us Your consent. Users may opt-out of receiving direct marketing and promotional e-mails by following the instructions included in all those emails, or informing MealPlanner about this using the contact details below. You may also separately opt-out of receiving only such marketing, which includes profiling related to it. If You opt-out, MealPlanner may still send You non-promotional customer information, such as emails about Your account or MealPlanner’s ongoing business relations.

In addition to the foregoing, You have at any time the right to object all such processing of Your personal data which is based on legitimate interests of either MealPlanner or third parties.

You have the right to request MealPlanner to restrict the processing or your personal data for the time it takes to verify the accuracy of Your personal data after You might have contested it, when MealPlanner no longer needs Your personal data for the purposes of processing, but is entitled to store it for the establishment, exercise or defense of legal claims, or on other grounds defined in the applicable data privacy legislation.

[Finally, upon Your request You also have the right to receive the personal data concerning You that You yourself have provided to MealPlanner in a structured, commonly used and machine-readable format and to transmit that data to another data controller, for the part that the processing of Your personal data has been carried out by automated means. You have the right to have Your personal data transmitted directly from MealPlanner to another controller, where this is technically feasible.

10. CHOICE OF LAW AND THE RIGHT TO LODGE A COMPLAINT TO THE SUPERVISORY AUTHORITY

In case You suspect a breach of data protection legislation and the matter is not solved amicably between You and us by negotiating, you may contact the Finnish Data Protection authority to lodge a complaint.

11. CHANGES TO PRIVACY POLICY

MealPlanner may change this Privacy Policy from time to time. All changes here to will be made available on the MealPlanner website, and if this Privacy Policy is changed in a material, adverse way, we will post a notice 30 days in advance advising of such change on our website and other main service channels such as mobile application. We warmly recommend you to re-visit this Policy from time to time to notice any such changes. The changes will be effective when made available, and Your continued use of FoodToDo indicates your consent to the changed Privacy Policy posted at the time of use. Changes hereto will not substantially prejudice Your rights without Your consent.
